Terms of Service

1. Acceptance

By creating an account on QTask ("the Platform"), operated by QTask Ltd ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

These terms are governed by the laws of New Zealand. Any dispute arising from these terms will be subject to the exclusive jurisdiction of the New Zealand courts.

2. Description of Service

QTask is an equipment maintenance management platform that enables equipment owners (Customers), service providers, and certifiers to schedule, record, and certify equipment maintenance activities.

We provide the platform as a software service. We are not a maintenance provider, certifying authority, or WorkSafe-accredited body. All maintenance work and certifications are performed by the registered users of the platform, not by QTask.

3. Accounts and Roles

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

The Platform has four user roles:

  • Customer (Equipment Owner): Can register equipment, create maintenance schedules, and view records and certificates.
  • Service Provider: Can accept maintenance jobs, submit service records, and record labour and costs.
  • Certifier: Can review completed maintenance records and issue compliance certificates.
  • Administrator: Has full access to manage the platform and its users.

You must only register under a role that accurately reflects your qualifications and authority. Misrepresenting your role — particularly as a Certifier — may have legal consequences under NZ workplace health and safety law.

4. Certifier Responsibilities

Users registered as Certifiers acknowledge that issuing a compliance certificate through QTask carries the same legal weight as issuing one through any other means. By approving a certificate, you represent that:

  • You are duly authorised and accredited to issue the type of certificate being issued.
  • You have reviewed the underlying maintenance record and are satisfied it meets the applicable standard.
  • The certificate accurately reflects the outcome of the inspection or maintenance activity.

QTask is not responsible for certificates issued by Certifiers on the Platform. Certifiers bear full professional and legal responsibility for any certificate they issue.

5. Acceptable Use

You agree not to:

  • Upload false, misleading, or fraudulent maintenance records or certificates.
  • Access or attempt to access another user's account or data without authorisation.
  • Use the Platform for any unlawful purpose or in violation of any applicable law.
  • Attempt to reverse-engineer, decompile, or extract the source code of the Platform.
  • Introduce malware, viruses, or other harmful code into the Platform.
  • Use automated tools to scrape, crawl, or bulk-download data from the Platform.

We reserve the right to suspend or terminate any account that violates these terms, without notice if necessary to protect the integrity of the Platform or other users.

6. Data Ownership

You retain ownership of all data you upload to the Platform, including equipment records, maintenance records, and certifications. By uploading data, you grant QTask a limited licence to store, process, and display that data solely for the purpose of providing the service to you.

We will not access your data except for the purpose of providing the service, resolving technical issues, or as required by law.

7. Record Keeping Obligations

The Platform is designed to assist you in meeting your record-keeping obligations under New Zealand law. However, it is your responsibility to ensure that:

  • Records are accurate and complete at the time of entry.
  • Any legal retention requirements specific to your industry or equipment type are met.
  • You maintain appropriate backup copies of critical compliance records.

QTask retains records in accordance with our Privacy Policy. We are not liable for any failure to meet your legal obligations arising from your use of the Platform.

8. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may perform scheduled maintenance that temporarily affects access. We will endeavour to provide advance notice of planned downtime where possible.

We are not liable for any loss or damage arising from service unavailability, data loss, or platform errors, to the extent permitted by the Consumer Guarantees Act 1993 (NZ).

9. Limitation of Liability

To the maximum extent permitted by law, QTask's total liability for any claim arising from your use of the Platform is limited to the amount you paid us in the 12 months preceding the claim.

We are not liable for indirect, incidental, special, or consequential losses, including loss of data, loss of revenue, or regulatory penalties arising from your use of the Platform.

Nothing in these terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify registered users by email of material changes at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised terms.
